With the rise of artificial intelligence, companies are facing major challenges, including:

  • Contractual issues: companies must adapt their contracts to take into account the specificities and risks associated with the use of AI (lawfulness of the training phase, data quality, bias and errors, security, confidentiality, etc.).
    It is therefore essential to asses, in advance, the real implications of the technology used, identify specific threats, carefully select suppliers, and work closely with them to incorporate clauses that are relevant to the operational use of AI tools and the scope for negotiation.
  • Governance: companies must implement AI governance programs to control the risks associated with this technology and comply with the regulatory framework, while preserving both their commercial interests and the value created.   5. Train employees and raise awareness about this new technology and its associated best practices.
